These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age and accept delivery. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Description of Goods
Many of the products we sell are of a descriptive nature and it is not practical to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising on our site are for the sole purpose of giving an approximate description of the goods..

All product specifications, images and other information published on our website have either been made accessible by suppliers, manufacturer's, publications, publicists, or been gathered from public-domain sources. The intention of Sparkling Jewellery is that all information on the website should be as accurate and up to date as possible. However Sparkling Jewellery cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.
In the event a product is listed at an incorrect price due to typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account to the value of the incorrect price (including delivery charges).

Making A Purchase
Making a purchase could not be easier. Just browse our Catalogue, and click on any items that you wish to buy and put them into the shopping cart. After you have finished your selection, click on "Order" and you will be asked for a few details that we need to be able to satisfy the order.
We accept all major credit and debit cards, Mastercard, Switch, Solo, Visa, Electron via Shopify and PayPal .

Terms and Conditions: PUT IT ON LAY-BUY
Layby Terms, agreements and contract
Lay-Buy Financial Solutions Pty Ltd trading as www.lay-buys.com has identified core principles we believe are integral and imperative for all Lay-Buy agreement deals transacted through our PUT IT ON LAY-BUY checkout payment option to be fair and reasonable per the Fair Trading Act 1999.
The following principles below therefore make up the Terms & Conditions for any Lay-Buy or Layby contract and related transactions entered into. This applies to all and any lay-by contract template utilized by both the vendor or consumer:
Record of Payment
A record of payments transaction history will always be available for both the merchant and buyer, recording all amounts paid to-date and the date and value of all future pending payments as per your agreed lay-by policy.
Storage and Identification of Lay-Buy Products
Product’s on Lay-Buy will be set aside and stored separately to other products. Products will be clearly identified as ‘Lay-By contract’ products by a number or some other identification.
Cancellation of Lay-Buy by Buyer
The buyer may cancel their LayBy agreement form at any time prior to delivery of products and on delivery of products if the products are damaged by so advising seller in writing or if seller agrees, orally.If a buyer cancels a Lay-Buy, seller will, if so requested by the seller, give the buyer a “cancellation statement” which sets out-
a) The purchase price of the products; and
b) Advise customer of the cancellation fee payable to seller under all Lay-By terms and conditions; and
c) The total amount paid under the Lay-Buy; and
d) Any amount owing to either the buyer or seller under the layby terms on the cancellation of the Lay-Buy.If seller does not accept the buyer’s oral cancellation it is obliged to give/send the buyer a duly completed Lay-By Form of Cancellation immediately.
Cancellation of Lay-Buy by Seller
The seller under a Lay-Buy must not cancel it unless –
a) The buyer breaches a term of the Lay-Buy; or
b) The seller stops trading; or
c) The products are no longer available
Cancellation on breach by Buyer
If a buyer has breached a term of a Lay-Buy and seller intends to cancel the Lay-Buy, before doing so seller must –
a) Give the buyer notice of seller’s intention to cancel the Lay-Buy; and
b) Allow the buyer at least 14 days within which to rectify the breach; and
c) The notice to be given has to be:I) in writing, sent to the buyer’s last known address, or, if the buyer so agrees, orally; and
II) must specify the breach of the Lay-Buy for which the Lay-Buy is being cancelled; and
III) must state the time within which the buyer must rectify the breach;
IV) must state the matters listed per below:* the purchase price of the products;
* all cancellation charges payable under the agreement; and
* the total amount paid under the Lay-Buy;
* any amount owing to either the buyer or seller under the terms of the Lay-Buy on the cancellation of the Lay-Buy.The Lay-Buy is cancelled at the end of the period specified in the notice unless the buyer rectifies the breach before then or Seller agrees not to cancel it.
Cancellation where business closes
If Seller under a Lay-Buy agreement proposes to stop trading before the agreement is completed, Seller must give notice of the proposal to the buyer and must either –
(a) allow the buyer 7 days within which to complete the agreement; and
(b) cancel the Lay-Buy
Cancellation where products not available
If the products are no longer available, Seller must cancel the Lay-Buy and refund all monies to the buyer.
Effect of Cancellation
Subject to the above, when a Lay-Buy is cancelled by either party, Seller must refund all money paid within 14 days less a AUD $25 cancellation fee. There are circumstances which prohibit Seller from keeping the cancellation charge. These include but are not limited to, situations where the products are damaged or not delivered or where Seller has breached a term of the Lay-Buy statement.
Seller shall charge the buyer a AUD $25 cancellation fee under the terms of all Lay-Buy deals.
Banking Charges back Fees
The seller shall be entitled to pass-on to the buyer all charge back fees received by any given bank for any given customer charge back from any given Lay-Buy deal.
Seller shall not charge the customer any interest charges, membership fee or service fee on any Lay-Buy sales transaction. Lay-Buy Financial Solutions Pty Ltd trading as www.lay-buys.com charge an admin fee, which is a once-off 0.9% of the total order value at checkout. The buyer will pay this amount to Lay-Buys at checkout at time of paying the down payment. This fee is an admin fee and is therefore not refundable.
Seller shall have reporting in place for all Lay-Buy deals covering Down Payment made, Lay-Buy period, Frequency of payments required, Payment amount required per installment; and a full record of all payments made to-date (amount and date on which made).
The seller will only dispatch the buyer product/s after receiving the final installment payment for all Lay-Buy deals.
14.1 This Agreement shall be binding upon, inure to the benefit of, and be enforceable by the representatives, successors and assigns of the parties hereto.
14.2 This Agreement may be amended only by a written instrument duly executed by all parties hereto.
14.3 The parties hereby represent and warrant that each of them has full legal right, power and authority to enter into this Agreement and to carry out its obligations hereunder.
14.4 This Agreement may be executed simultaneously in one or more counterparts, each of which shall be deemed an original but all of which together shall constitute one and the same instrument.
14.5 Article headings contained herein are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement.
UK Delivery of products (stock items) will normally be the same day if the order is before 1pm from clearance of payment. Any dates we specify for the delivery of the goods are approximate only and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. If we are temporarily out of stock, we will notify you of this position and advise you of an approximate date for dispatch of the goods. For delays of more than 28 days, you will have the right to cancel the order and we will refund any money paid by you for the goods. All pre ordered items will be dispatched as soon as they come into stock and before they are re-published on the website.
All prices on our website are exclusive of delivery & packing charges which will be added to the price of the products at our checkout. All goods are sent in plastic bags or cellophane wrappers as dispatched from the factory.

Sometimes orders sent by Royal Mail may be delayed we keep all tracking numbers in the office please call or email if you would like your number to track. Credit Card Security
All credit card are handled by Shopify or Paypal on their own secure servers. We do not retain or have access to any credit card numbers or details. Please see Protx or Paypal web sites for further security details. All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption.

We reserve the right to release this information. If permission is granted by a director of Little Mollands Jewellers for use of our images and intellectual property it is for for personal use only we do not authorised commercial use. Any other use, without the written permission of Sparkling Jewellery, is strictly prohibited and will be pursued by our legal representatives. We take copyright of our goods very seriously and will pursue anyone that copies our design and or intellectual property.
Notification of changes
Your rights to return goods are protected under the EU 2000 Distance Selling Directive.
You are entitled to cancel your order and return the goods within 7 working days for a refund, not including the delivery charges. To return items please do this by filling in the returns notice sent with every single item with in 7 days of receipt. Your refund will be paid within 30 days by the original method of payment. You are responsible for the cost and risk of loss or damage when returning the goods, so you should take out enough postal insurance to cover their value. This cancellation policy does not affect your rights when we are at fault - for example, if goods are faulty or misdescribed. If your item has been sent with free postage and packing we will debit the COST of the post to you which is £5-50 for special delivery. Please note that refunds can take up to 30 days to process which is within the parameters of the law.
Any goods returned should be in a unused and saleable condition and returned with its packaging. If goods are returned to us in a condition that is not unused or saleable we will return the item to you by the cheapest method available to us and not refund. If any item is returned with evidence of wear such as the security tags removed we have the right to return to you without refunding. ALL items must be re-sellable when returning which means the tags must be in place.
These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply in the future.
None of these terms affect your legal rights and these are not diminished in any way. If any term is held to be invalid under any applicable statute or rule of law, that term is automatically omitted from the terms to minimum extent necessary to comply with the law and without affecting the validity or enforceability of the remainder.

We offer a full exchange service for an item that is not suitable if given as a gift or if an incorrect size is requested. In this instance you have 14 days from receipt of the goods to request a replacement or exchange. At Christmas we may extend this period to accept the return by the 6th of January. We do not refund after 7 days of receiving an item.
CHRISTMAS RETURNS. PLEASE NOTE THAT ANY RETURN SENT TO US AFTER THE 6TH OF JANUARY WILL ONLY BE APPLICABLE FOR AN EXCHANGE WE WILL NOT REFUND YOUR ITEM.
Earrings and Body Jewellery
Earrings and body jewellery cannot be returned for an exchange or refund unless faulty. All earrings are inspected on dispatch by our packing staff and their line manager meaning any faults will be addressed before dispatch.
How to return an item If you require a refund
- The item must be sent within 7 days of receipt.
- The item must be returned with a returns form if a form is not completed then it may take longer to process.
- All packaging must be returned.
- Any item with a security tag tampered with or removed may not be returned.
- The item MUST be in a saleable condition and unused.
- The return should be sent by a signed for postal service with sufficient insurance.
- You do not need to contact us if you are returning an item just send with in 7 days and the completed returns form

If you would like an item exchanged because you have bought a gift that is not suitable, you have requested the wrong size or you have left it too long for a refund you have 14 days from receipt of the goods to do this. Please return again with the packaging, all items must be in a saleable condition and have any security tags still in place and untampered with. The returns form must be completed with the replacement item stated and the replacement size if you would like a different size ring. At Christmas we may extend this time to 28 days. Earrings cannot be exchanged or refunded unless faulty. All items are hand checked on dispatch.
How is my refund calculated?
Your refund will be the initial item cost, less any postal charges for getting the item to you. In the event of an item being sent with free delivery our post and packing fee of £5-50 will be deducted. If postage was paid for then we will not refund this fee.
How long do I have to return an item?
For a refund you must return the item within 7days of receipt of the goods arriving with you. We can track this date from your individual special delivery number. Goods sent after this time will not be processed and will be sent back to the original delivery address.
For an exchange you have an additional 7 days making it 14 days from receipt of the goods arriving. We can track this date from your individual special delivery number. Goods sent after this time will not be processed and will be sent back to the original delivery address. At Christmas we may extend this to 28 days.
How long will my refund take?
All refunds will be made by the original method of payment within 30 days of receipt of the goods arriving with us. Some banks may take longer to show the transaction in your account so please allow an additional 7 days clearance time to your bank account. If you have paid by paypal they will process your refund to the original method of payment.
If you can not find your returns form please print and return with your item to ensure a speedy refund. All returns sent without a form will take longer to process
